Terms of Service

1. Welcome
These Terms of Service (“Terms”) govern your use of goCaju (“we”, “us”, “our”), accessible at gocaju.com and gocaju.app.
By creating an account or using goCaju, you agree to these Terms. If you don’t agree, don’t use goCaju.
2. Who can use goCaju
You can use goCaju if:
- You are at least 18 years old, or you are a minor between 16 and 18 with verifiable parental consent.
- You can form a binding contract under your local law.
- You’re not barred from using goCaju under applicable law.
If you use goCaju on behalf of a business, gym, or sports team, you represent that you have authority to bind that organization to these Terms.
3. Coaches and athletes
goCaju is built for two types of users:
- Coaches — personal trainers, S&C coaches, gyms, and sports teams. Coaches manage athletes and see their nutrition data.
- Athletes — individuals invited by a coach to log their meals.
Coaches are responsible for:
- Ensuring their athletes consent to using goCaju and to sharing nutrition data with the coach.
- Providing nutrition guidance within the coach’s professional scope.
- Complying with local regulations applicable to their coaching practice.
goCaju is a software tool. We do not provide medical, dietary, or nutrition advice. Coaches are solely responsible for the advice they give their athletes.
4. Your account
You must provide accurate information when creating an account and keep it up to date. You are responsible for safeguarding your password and for any activity under your account.
Notify us immediately at support@gocaju.com if you suspect unauthorized access.
5. Acceptable use
When using goCaju, you agree not to:
- Use the service for anything illegal or that violates someone else’s rights.
- Upload content that is harmful, abusive, defamatory, obscene, or infringing.
- Reverse engineer, scrape, or copy goCaju except as permitted by law.
- Resell or redistribute goCaju without our written permission.
- Use goCaju to send spam or unsolicited communications.
- Impersonate anyone or misrepresent your affiliation.
- Attempt to interfere with the security or operation of the service.
- Use goCaju to provide medical diagnosis, treatment, or care that requires a licensed professional.
- Use AI features to generate content that violates OpenAI’s usage policies.
We may suspend or terminate accounts that violate these rules.
6. Subscriptions, billing, and the founding offer
Founding offer
The first 50 coaches who join goCaju get every feature free for life, for up to 20 athletes. The free-for-life status applies as long as you maintain an active account in good standing. We may modify the included features in good faith, but we won’t strip the offer from coaches who joined under it.
Paid plans
After the founding offer is filled, paid plans start at €19/month and are billed monthly or annually via Stripe. Prices are shown on the pricing page.
Cancellation
You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We don’t issue partial refunds for unused time, except where required by law.
Refunds
We don’t offer refunds on paid subscriptions, except where required by consumer law in your jurisdiction. If you believe you’ve been charged in error, contact billing@gocaju.com within 14 days of the charge.
Price changes
We may change prices for new sign-ups at any time. For existing paid subscribers, we’ll notify you at least 30 days in advance of any price increase, and you can cancel before it takes effect.
7. Your content
You retain ownership of all data you upload to goCaju (meal logs, photos, chat messages, coaching plans).
You grant us a limited, non-exclusive, worldwide license to host, store, process, and display your content solely to operate the service for you. We don’t use your content to train AI models. We don’t sell your content. We don’t share your content with anyone except as needed to provide the service (see our Privacy Policy).
You’re responsible for the content you upload. Don’t upload content you don’t have rights to use.
8. Coach data ownership
Coaches own their athlete roster, the configuration of their account, and the aggregated insights they generate.
When a coach loses access to an athlete (athlete disconnects, coach cancels), the athlete retains their own data.
When a coach exports data (CSV), they’re responsible for handling that exported data in line with applicable privacy laws.
9. Service availability
We aim for high uptime but we don’t guarantee uninterrupted service. We may perform maintenance, updates, or improvements that temporarily limit access. We’ll notify you in advance for planned maintenance when possible.
We’re not liable for downtime caused by force majeure, third-party providers (Supabase, OpenAI, Stripe, hosting), or events outside our reasonable control.
10. Changes to the service
We may add, change, or remove features over time. Material changes that reduce functionality you rely on will be communicated in advance.
We may discontinue goCaju entirely at our discretion. If we do, we’ll give you at least 60 days’ notice and a way to export your data.
11. Termination
You can stop using goCaju and delete your account at any time.
We may suspend or terminate your access if:
- You violate these Terms.
- You don’t pay (for paid plans).
- We’re required to by law.
- Your account is inactive for an extended period (we’ll notify you first).
After termination, your data is retained for 30 days, then permanently deleted, unless we’re legally required to retain it longer.
12. Disclaimers
goCaju is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We don’t warrant that:
- The service will be uninterrupted, secure, or error-free.
- AI meal recognition or AI assistant outputs will be accurate.
- The service will meet your specific requirements.
AI accuracy: AI features estimate calories, macros, and nutrition information. They are not a substitute for professional nutritional advice. Coaches and athletes should treat AI outputs as estimates, not medical guidance.
13. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) €100.
We’re not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill.
Some jurisdictions don’t allow these limitations — they apply to you only to the extent permitted in your jurisdiction.
14. Indemnification
You agree to indemnify and hold goCaju harmless from any claim, loss, or expense (including reasonable legal fees) arising from your violation of these Terms, your use of the service, or your content.
15. Governing law
These Terms are governed by the laws of France. Disputes will be resolved in the courts of France, unless your local consumer law gives you the right to bring claims in your home jurisdiction.
16. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent version. Material changes will be communicated by email or in-app notice at least 30 days in advance.
Continued use of goCaju after changes take effect means you accept the new Terms. If you don’t agree, stop using the service.
